Illegal Street Racing Attorneys

Street racing is both dangerous and illegal in Florida. The most recent Florida statute to address this is Section 316.191. This was enacted back in 2022, as street racing and related events – such as street takeovers, competitions, drag races, stunt driving and the like– had become common. In the four-year period from 2018 to 2022 there were over 6,600 citations given out under state law.

Those who face street racing citations or charges could also face long-term ramifications. Even spectators can be given traffic infractions, while drivers can sometimes face first-degree misdemeanors.

Florida Street Racing Potential Ramifications

Street racing charges can bring ramifications, driver’s license revocation, financial fines, a vehicle impoundment or even time behind bars. It often depends on the number of violations.

  • First violation: Misdemeanor charges, a one-year driver’s license revocation, fines up to $1,000.
  • Second violation: Driver’s license revocation for two years, fines of up to $3,000.
  • Third violation: Driver’s license revocation for four years, fines of up to $5,000.

Spectators can even face civil penalties simply for watching a street race or a street takeover. This could result in fines or fees, even though it is not technically a criminal charge. These events impede traffic, so the police do have the option to arrest anyone who is involved, even if they are not technically behind the wheel. For instance, an intersection takeover may only involve one driver doing burnouts in the intersection, and that driver may run when police arrive. But dozens or hundreds of people may be watching, and they could be arrested even though they never violated traffic laws themselves.
